Discussion
The Cooperative allows third-party entities to attach its equipment to PEC's facilities upon satisfaction of various conditions. One requirement for attachment to PEC's facilities is the execution of pole attachment agreements. Generally, the pole attachment agreements and standards set forth the rental rates and other charges for the attachment to PEC's facilities. In May 1997, the Board approved a waiver for charging pole attachment fees for school programs. In 2004, the Board approved various rates and fees to be charged for the attachment to PEC's facilities. In April 2020, the Board approved a new structure for rates and charges for third parties to attach to PEC facilities. In November 2021, the Board discussed additional updates to the pole attachment rate structure.
Given a review of the Cooperative's costs since 2020 and to further allocate costs for use of PEC's facilities with third parties, the rate structure requires review. The Board will now consider updating the pole attachment rate structure and charges for third-parties to attach to PEC's facilities and discontinuing any waiver for charging of pole attachment rates for school districts and charge the applicable pole attachment rates and fees for school programs, school districts and schools beginning January 1, 2024 as outlined in the Pole Attachment Standards.
