Discussion
Pursuant to Chapter 37 of the Texas Utilities Code, the Public Utility Commission of Texas (“PUC”) requires a certificate of convenience and necessity for an electric cooperative (and other utilities) to serve the public in its service territory. Pedernales Electric Cooperative, Inc. (the “Cooperative”) holds a certificate of convenience and necessity (“CCN”) for its service territory. To amend its CCN the Cooperative must submit an application to the Commission.

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE COOPERATIVE, that the Cooperative file an appropriate application its Certificate of Convenience and Necessity with the Public Utility Commission of Texas as discussed in Executive Session; and
BE IT FURTHER RESOLVED, that the Chief Executive Officer or designee is hereby authorized to take such actions as needed to implement this resolution.
